Who We Are.
Federal firearms licensees are notorious
for failing to recognize when they need a legal “specialist” to handle their specific,
firearms related issues. Instead, they rely on the local lawyer,
or the lawyer “friend” in town. Experts have analogized
it to “the patient who visits a foot doctor to handle a brain
tumor.” Yet few FFL dealers across the United States can afford
to retain full-time, firearms-specific legal counsel – like
firearms manufacturers and distributors do – to educate them
as to legal nuances to preserve their federal firearms license, to
defend against lawsuits, and to insure the integrity of a BATF inquiry. Until
now.
FFLGuard is a program offered by The
Chiafullo Group, LLP (“the Group”), a law firm that employs other firearms-trained
counsel across the country to aid in the common defense of federal
firearms licensees. All counsel engaged by the Group have represented
manufacturers, distributors, and retail dealers in defense of various
claims, lawsuits, and other similarly-related legal situations. The
Group’s engagement of fellow firearms-specific counsel and paraprofessionals
specifically services the needs of the Group’s clients participating
in the FFLGuard program, and counsel collectively boasts decades
of experience handling firearms related cases. The Group is directed
by
Christopher M. Chiafullo, a firearms attorney who has dedicated
his practice to the defense of firearms manufacturers, distributors,
dealers, and trade groups for the last decade. The Group, or its co-counsel, also employ specifically-trained
para-professionals to counsel and guide FFLGuard participants
in compliance and other legal defense issues. The Group has
identified the engagement of like-minded counsel – and their
use of non-attorneys – as a priority in maintaining the privilege
of confidentiality between lawyer and client. Without this
privilege, non-attorney consultants operating on their own are subject
to disclosing sensitive information regarding each potential FFLGuard participant,
making each susceptible to the manipulations of anti-gun advocates. Now,
