What FFLGuard Offers
 
The Chiafullo Group, LLP (“the Group”), a law firm comprised of firearms-specific lawyers, offers its FFLGuard program to all valid federal firearm licensees.  By retaining the Group and participating in the FFLGuard program, an FFL enjoys an attorney/client relationship that delivers education, training, and rapid response relative to firearms-specific legal and federal firearms license-related issues.  Each participant in the Group’s FFLGuard program is provided with the FFLGuard Law Plus Guidelines, a comprehensive educational outline created and established by the Group, to elevate every Client’s business practices “above and beyond” what the law requires.  This extra effort by participants assures that each client is in good standing by anyone who might be sitting in judgment, whether in a court of law or public opinion.

Upon retaining the Group, electing to participate in the Group’s FFLGuard program, and adhering to the FFLGuard Law Plus Guidelines issued by the Group, each client is afforded certain legal services that include:  In the case of a BATF audit, an FFLGuard professional will be assigned to oversee the process, interface with the BATF, and contrast your audit to others around the country, in an effort to insure the integrity of the process and keep each client out of harm’s way.  If a client is named as a defendant in a lawsuit designed to call its business practices into question, FFLGuard-approved counsel will be at your service (subject to pre-established time caps) to defend you from plaintiffs aiming to bankrupt you through the legal system.  And, of course, a client participating in the FFLGuard program is entitled to up to one (1) hour of e-mail and/or telephone time with Group approved and retained legal professionals to discuss any problems, concerns, or issues encountered with legal defense or ATF compliance issues.  All this, plus other a la carte legal services, are available only to FFLGuard participants who have retained the Group.

The total cost of yearly retention (currently $2495) is split into two components: the oversight fee and the reserves.  One-third of the retention rate is immediately realized by the Group for its oversight of the FFLGuard program; the other two-thirds are held in trust for all FFLGuard participants for future access, assuming the FFLGuard Law Plus Guidelines have been followed.  If not, each participant is nevertheless eligible to receive its legal services for a rate equivalent to a 1/3 reduction of counsel’s normal and customary rate.  It’s that simple: follow the Guidelines and have your representation paid for by the pool of reserves to which you have already contributed when you retained the Group.

The Group’s FFLGuard program is, however, only as strong as its Membership.  Your participation is vital to afford every dealer across the country with bona fide, adequate, and much-needed legal counsel.
