How FFLGuard Works
The Chiafullo Group, LLP (“the Group”)
offers its
FFLGuard
program as real-time legal services.
FFLGuard
IS NOT INSURANCE and IS NOT PRE-PAID
LEGAL SERVICES. Instead, participating in the Group’s
FFLGuard program forms an active lawyer/client
relationship between you – a valid federal firearms licensee – and
your counsel in the Group and/or its agents.
Two-thirds of your yearly retention fee
(currently $2495) is held in attorney trust for your potential use, or
for use by fellow
FFLGuard
participants, subject to the
FFLGuard Law Plus Guidelines and your retainer agreement
with the Group; the remaining third acts as a flat fee to the Group
for their oversight services and your access to our “CLIENTS ONLY” web
page that keeps you up to date on compliance issues. Each participant
in the
FFLGuard program may be eligible to access that
pool of trust money to pay legal fees should the participant be
subject to an ATF audit or civil litigation aimed at scrutinizing your
business practices. And, of course, your participation in the program
entitles you to consult with your lawyers on any
firearms-related issue that may cause you concern at a rate discounted
by virtue of your participation in the
FFLGuard program. It’s
that simple.
This grass-roots effort requires the
collaboration and cooperation of multiple retail dealers to, in effect,
collectively retain legal professionals and “share” these professionals with
other retail dealers. All
FFLGuard
participants
must adhere to the
FFLGuard Law Plus Guidelines
to gain access to the reserve funds held in trust for occasions where an audit
or lawsuit may be instituted against you. Even if the
FFLGuard Law Plus
Guidelines are not strictly followed, you are never
without cost-effective representation: your participation fee entitles you to
retain FFLGuard
approved counsel at a rate reduced by 1/3 of counsel’s normal and customary
rate.
Solidarity is the first step towards the sense of legal security that all
federal firearms licensees seek in the current political climate.
